Product Availability
Product availability is subject to change at any time. In case an order should exceed the quantity existing in the warehouse, PiastrelleSupermarket.it shall immediately notify the lack of availability or the possible waiting for the fulfillment of the order; if the customer and/or consumer does not agree to wait for the time necessary for delivery the contract shall be considered terminated and PiastrelleSupermarket.it shall refund the payment.
 
Billing 
Upon specific request of the Customer during the order process, it is possible to issue the commercial invoice that will be sent after the delivery of the goods.

Pursuant to the D.Legislative Decree No. 196 of 30 June 2003 "Protection of persons and other subjects regarding the processing of personal data" (hereinafter referred to as "Law"):
PURPOSES OF PROCESSING
The processing of data has the purposes directly connected and instrumental to the provision of the service requested.
In addition, the processing of data will also be carried out for market surveys, sending advertising material, marketing activities and business-related information regarding products and services of companies exhibiting on the portal, in any way and by any means carried out; survey of the degree of user satisfaction with the quality of products and/or services rendered and the activity carried out by the company exhibiting on the portal, carried out directly or through the work of specialized companies through personal interviews or telephone interviews, questionnaires, etc.
METHODS OF PROCESSING
The data will be processed mainly with electronic and computerised instruments and stored both on computer and on paper and on any other suitable type of support, in compliance with the minimum security measures pursuant to the Technical Specifications on minimum security measures, Attachment B of the Code regarding the processing of personal data.
OPTIONAL NATURE OF DATA ACQUISITION
Acquiring personal data is optional. However, failure to provide, even partially, the personal data required to fill out the Registration Form for Access to the Service may make it impossible to proceed with the complete provision of the Service itself.
SUBJECTS TO WHOM PERSONAL DATA MAY BE DISCLOSED
Personal data may be communicated to the Company's staff, who perform the functions of data controller and processor; the staff has been duly instructed in the security and protection of personal data; in any case, the prohibition to communicate or disseminate personal data to persons not necessary for the performance of services remains unaffected.

In relation to the processing of personal data, pursuant to art. 7 (Right of access to personal data and other rights) of the Code on the processing of personal data you have the right to obtain confirmation of the existence or not of personal data concerning you, even if not yet recorded, and their communication in an intelligible form. You have the right to obtain information on:
the origin of the personal data, the purposes and methods of processing, the logic applied in case of processing carried out with the help of electronic means, the identification data of the owner and managers of the subjects or categories of subjects to whom the data may be communicated or who can learn about them as appointed representative in the State, managers or agents.

You are entitled to obtain:
the updating or integration of data the cancellation, transformation into anonymous form or blocking of data processed unlawfully, including data whose retention is necessary for the purposes for which the data were collected or subsequently processed.

You have the right to object, in whole or in part:
for legitimate reasons, to the processing of personal data concerning you, even if pertinent to the purpose of collection, to the processing of personal data concerning you for the purpose of sending advertising materials or direct selling or for carrying out market research or commercial communication.

Diritto di Recesso
PiastrelleSupermarket.it recognizes to the consumer, who for any reason is not satisfied, the right of withdrawal as provided for by current legislation without penalty and without specifying the reason.
This right can be exercised only by consumers, therefore all purchases made for purposes not unrelated to the business or professional activity, i.e. where a VAT number is included in the order form, do not enjoy this right.
The deadline to exercise this right is 14 days from receipt of the goods, within which the customer is required to return the goods and give us notice by registered letter to the address: Gengotti srl - via fiume, 10 Campiano di talamello (RN) - P. iva 02255400414
If the right of withdrawal is expressed by fax or e-mail through our contact form, it must be confirmed by registered letter with return receipt to the above address, within the following 48 hours.

Please note: in the letter requesting the right of withdrawal it is necessary to indicate the details of a bank or postal account to re-credit the amount due (CIN Code, ABI Code, CAB Code, Account Number, Account Holder).
In order to exercise the right of withdrawal it is necessary that:
the Customer expresses his willingness to exercise the right of withdrawal in the manner described above the purchased good is unused, intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment);
the product is returned in the time and manner described above. Delivery costs are at the expense of the Customer. It is understood that the risks of transport for the return of the items are fully borne by the consumer. 

PiastrelleSupermarket.it is in no way liable for damage or theft/loss of goods returned by uninsured shipments. Under no circumstances will cash on delivery or carriage forward parcels be collected.
After checking the integrity of the goods, we will re-credit the amount already paid by bank transfer to the bank account you have communicated to our Customer Service.


WHEN DOES THE RIGHT OF WITHDRAWAL BECOME VOID?
The right of withdrawal becomes void in cases where PiastrelleSupermarket.it ascertains:
Use even partial use of the goods; The lack of the
outer packaging and / or the original internal packaging
; The absence of integral elements of the product;
Damage to the product for reasons other than its transport.

In the above cases, PiastrelleSupermarket.it shall return the purchased goods to the sender, charging the sender the shipping costs.

Shipping costs
PiastrelleSupermarket.it delivers its products within the Italian National Territory, in the Republic of San Marino, in the Vatican City, in all European Union countries and in the rest of the world.
Shipping costs are calculated according to the area of destination and are shown during the purchase process.


What should I do once I receive the product?
When the courier will deliver the goods, the customer and/or consumer must verify that the package is intact, not damaged or wet and in any case conforms to the standard characteristics of a package.
Any complaints must be immediately raised with the carrier, in the absence of these, the product is considered correctly delivered.
The consumer and / or customer from the moment he receives the damaged goods or request the return to the carrier has direct and exclusive action against the carrier itself. The latter is also responsible for the delay in delivery of the goods to the recipient.
In such cases, Gengotti srl shall be exempt from any liability for loss or damage of the goods from the moment they are delivered without reservation to the carrier for transport.

What should I do in case of damages due to Transport?
If the delivery of the goods results in a clear damage to the packaging it is necessary to:
express a reservation or the package is accepted but before signing the document you must write "I accept with right of reservation", it will be possible once opened the package and found any damage, be compensated for the damage suffered according to the parameters of compensation of Legislative Decree no. 286 of 21/11/2005.
reject the damaged goods if it is not possible to accept the package with reserve or if the damage is still visible without having to open the parcel.

Purchaser’s Obligations
It is forbidden for the purchaser to enter false and/or fictitious data in the registration procedure necessary to activate the procedure for the execution of this contract and further related communications; personal data and e-mails must be exclusively his real personal data and not of third persons or fictitious ones.
The consumer and/or customer authorizes Gengotti srl - via fiume,10 (RN) and undertakes to provide, at the latter's discretionary request, copies of identity documents not expired.
Failure to comply with the request for documents authorizes Gengotti srl - via fiume,10 (RN) to terminate the contract for breach of contract by the buyer.
The customer releases Gengotti srl - via fiume,10 (RN) from any liability arising from the issue of incorrect tax documents due to errors in the data provided by the customer, being the customer himself the only responsible for the correct insertion.
The customer undertakes, once the on-line purchase procedure has been completed, to print and keep these general conditions, which he will have already viewed and accepted as an obligatory step in the purchase, and to print the specifications of the product to be purchased.
The guarantee of the successful completion of the payment that the customer makes by the means indicated above, is essential, so that by express agreement the failure by the customer to comply with this obligation will result in the termination of the contract without the need for judicial decision, without prejudice to the right of Gengotti srl - via fiume,10 (RN) to take legal action for compensation for further damage.

Contract Termination and Express Termination Clause
Gengotti srl - via fiume,10 (RN) has the right to terminate the contract by simply notifying the consumer and / or customer with adequate and justified reasons; in this case the customer will only be entitled to a refund of any amount already paid.
